By accessing or using the GoPokoloko mobile application (the “App”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App.

User Accounts

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

User Obligations

As a user of the App, you agree to use the App only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the App. Prohibited activities include, but are not limited to, the following: transmitting any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content; impersonating any person or entity or misrepresenting your affiliation with a person or entity; and engaging in any activity that could damage, disable, overburden, or impair the App.

Payment and Fees

The App may offer features that require payment. By using these features, you agree to pay all applicable fees and taxes. Payments will be processed through our third-party payment processor, and you agree to comply with their terms and conditions. Secure payment options are available through various gateways, including credit/debit cards, mobile wallets, or integrated options (e.g., Google Pay, Apple Pay). All fees are non-refundable unless otherwise stated.

Content and Intellectual Property

All content, features, and functionality on the App, including but not limited to text, graphics, logos, images, and software, are the exclusive property of GoPokoloko and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App without the prior written consent of GoPokoloko.

User-Generated Content

If you submit, post, or otherwise transmit any content to the App, you grant GoPokoloko a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, publish, and distribute such content in any media. You represent and warrant that you own or have the necessary rights to the content you submit and that such content does not violate any third-party rights.

Dispute Resolution

Any dispute arising out of or related to these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of American Arbitration Association (AAA) in United States. You agree that any arbitration will be conducted on an individual basis and not in a class, consolidated, or representative action.

Limitation of Liability

To the fullest extent permitted by law, GoPokoloko shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; or (iv) any bugs, viruses, or other harmful code that may be transmitted to or through the App by any third party.

Indemnification

You agree to indemnify, defend, and hold harmless GoPokoloko, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, service providers, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the App, including, but not limited to, your user-generated content, any use of the App’s content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the App.

Changes to These Terms

GoPokoloko reserves the right to modify or replace these Terms at any time. If we make material changes to these Terms, we will notify you by posting the updated Terms in the App. Your continued use of the App following the posting of any changes to these Terms constitutes acceptance of those changes.
